1.5 Where possible we always try to give advance warning of maintenance issues that may result in Application/Platform/Portal down time but we shall not be obliged to provide such notice. 

Data Retention Policy

1.6 In any Elephant IT LLP application given to customer has access of 30 days of tracking history data but as per Elephant IT LLP data retention policy, we can store past 6 months of tracking history data and can be provided to customer on request. We can remove all the tracking history data which is older than 6 months as per the policy.

VISITOR PROVIDED MATERIAL

1.7 Any material that a visitor to this Application/Platform/Portal sends or posts to this Application/Platform/Portal shall be considered non-proprietary and non-confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us, with the exception of personal information, the use of which is covered under our Privacy Policy 

1.8 When using this Application/Platform/Portal you shall not post or send to or from this Application/Platform/Portal any material: for which you have not obtained all necessary consents; that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in the India; which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data.

1.9 We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this Application/Platform/Portal in breach of Paragraph 1.7.

Although these details are taken by Elephant IT LLP they are processed using a secure payment facility managed by a third party organisation, any issues should be taken up with this provider directly. 

Elephant IT LLP will not pass on any of your personal account details to anyone other than our payment services provider.

Elephant IT LLP cannot be held responsible for any loss or misuse that may be suffered due to any third party company involvement.

LAW AND JURISDICTION

These terms of use are governed by Indian law.

Any dispute arising in connection with these terms of use shall be subject to the exclusive jurisdiction of the Courts of India.
